This Legal Statement contains the terms and conditions governing this site, www.wonderbra.ca, and all sites of the affiliates of Hanesbrands Branded Apparel Enterprises that are linked to this site (collectively, the “Sites”). Unless otherwise stated herein, any reference to “Hanesbrands” refers to Hanesbrands Branded Apparel Enterprises and all of its affiliates.

The information on the Sites is provided as a service to Hanesbrands’ stockholders, investors, customers and vendors. This information is made available only for your personal, non-commercial use. By accessing or using any of these Sites, you expressly accept and agree to abide by all the terms and conditions contained in this Legal Statement. Do not use any Site if you do not accept and agree to these terms and conditions.

Ownership
Hanesbrands owns all of the Sites and owns or has rights to use all of the wallpaper, icons, characters, artwork, images, graphics, music, text, software and other content of the Sites (the “Content”), and all HTML design, layouts, configurations, CGI and other code and scripts in any format used to implement the Sites (the “Code”). The Content and Code of the Sites are protected by copyright. Except for your personal, non-commercial use, you may not copy, distribute, modify, upload, download, transmit, re-publish, display or otherwise distribute any Code or Content for public or commercial purposes, without the prior written consent of Hanesbrands. All names, logos and trademarks that appear on the Sites are the property of Hanesbrands or are used by Hanesbrands under license. You may not use any of the foregoing for any purpose without the prior express written consent of Hanesbrands. Hanesbrands hereby grants a limited license to print media publishers to use the Logos and Product Photos found in our Image Gallery solely for the purpose of illustrating an article. Your failure to comply with this Legal Statement will constitute breach of contract and will violate Hanesbrands’ copyright, trademark and other proprietary and intellectual property rights.

No License
Except as expressly provided above, nothing contained herein shall be construed as conferring by implication, estoppel or otherwise any license or right under any patent, trademark, copyright or other proprietary or industrial right of Hanesbrands, its affiliates or any third party.

Use of Information Submitted By You
This Legal Statement does not apply to personal information supplied by you through any Site, such as your name, address, e-mail address, telephone number and similar information. Please see our Privacy Policy Statement for information regarding our treatment of personal information.

Any information (other than personal information) that you communicate or submit to Hanesbrands in any form, including but not limited to feedback, data, questions, comments, product ideas, know-how, applications or suggestions, shall not be deemed confidential or proprietary, even if such information is labeled confidential or proprietary. All such communications and submissions shall be deemed the property of Hanesbrands, and your submission of such information shall constitute your assignment to Hanesbrands of all worldwide rights, title and interest in and to such information. Hanesbrands will not have any obligation to keep such information confidential and will be free to reproduce, use, disclose and distribute the information to others without limitation and without liability. Hanesbrands will be free to use any ideas, concepts, know-how or techniques contained in such information for any purpose whatsoever, including but not limited to developing, manufacturing and marketing products that incorporate or otherwise embody such information, without providing you with any notice, compensation or attribution.

Hanesbrands welcomes your comments and suggestions on its Sites and products, but Hanesbrands does not seek to solicit any confidential or proprietary ideas, suggestions, materials or other information relating to developing, designing, redesigning, modifying, manufacturing or marketing its products or any new products. By submitting information to Hanesbrands, you warrant that Hanesbrands may publish such information, use it as part of its operations, and incorporate its concepts into Hanesbrands products without liability. You are prohibited from posting or transmitting to or from any Site any unlawful, threatening, libelous, defamatory, obscene or pornographic material, or any material that would violate any law.

Disclaimers
Hanesbrands publishes information on its Sites as a convenience to its visitors. Except for those Sites where products may be purchased, Hanesbrands product information is provided for informational purposes only. While Hanesbrands attempts to provide accurate and timely information, there may be inadvertent technical or factual inaccuracies and typographical errors. We reserve the right to make corrections and changes to the Sites at any time without notice. The Hanesbrands products described in its Sites may not be available in your region. Hanesbrands does not claim that the information in the Sites is appropriate to your jurisdiction or that the products described on the Sites will be available for purchase in all jurisdictions. Although Hanesbrands has made every effort to display the products and their colors as accurately as possible, the displayed colors of the products will depend upon the monitor of the user and Hanesbrands cannot guarantee that the user’s monitor will accurately portray the actual colors of the products.

It is possible that some software that may be downloaded from the Sites is subject to government export control or other restrictions. By using any Site, you acknowledge these restrictions and agree that you are not subject to them.

Visitors assume all responsibility and risk with respect to their use of the Sites. All information contained on the Sites is provided to you “AS IS” and Hanesbrands disclaims all warranties, representations and endorsements, express or implied, with regard to information accessed from or via the Sites, including but not limited to all express and implied warranties, such as warranty of title, merchantability, non-infringement and fitness for a particular purpose.

Hanesbrands disclaims any duty to update its Sites or modify their Content or Code, and Hanesbrands shall not be liable for its failure to update such information. Hanesbrands does not warrant that the Sites are free of computer viruses, bugs or other harmful components and does not warrant that the functionality of the Sites will be uninterrupted or error-free.

IN NO EVENT SHALL HANESBRANDS BE LIABLE FOR ANY DIRECT, SPECIAL, INDIRECT, OR CONSEQUENTIAL DAMAGES, OR ANY OTHER DAMAGES OF WHATEVER KIND RESULTING FROM WHATEVER CAUSE, INCLUDING BUT NOT LIMITED TO LOSS OF USE, LOSS OF PROFITS, LOSS OF DATA, OR ANY OTHER TYPE OF DAMAGE, TANGIBLE OR INTANGIBLE IN NATURE, WHETHER IN AN ACTION UNDER THEORIES OF CONTRACT, TORT OR OTHERWISE, ARISING OUT OF OR IN ANY WAY RELATING TO THE USE OR PERFORMANCE OF THE INFORMATION ON, OR ACCESSED THROUGH, HANESBRANDS’S SITES, EVEN IF HANESBRANDS HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. IF YOU BECOME DISSATISFIED IN ANY WAY WITH ANY SITE OR ANY CONTENT, YOUR SOLE AND EXCLUSIVE REMEDY IS TO STOP ACCESSING THE SITES.

Hanesbrands reserves the right to withdraw access to the Sites or to revise the services and products described in the Sites at any time without notice.

Hanesbrands may at any time revise the terms and conditions contained in this Legal Statement by updating this posting. You are bound by any revisions and should periodically visit this page to review the current terms and conditions that apply to your use of the Sites.
The invalidity of any term, condition or provision of this Legal Statement shall not affect the enforceability of those portions of the Legal Statement deemed enforceable by applicable courts of law.

Privacy Statement / Hanesbrands website
This Privacy Policy applies to this site and all sites of the affiliates of Hanesbrands Branded Apparel Enterprises (”Hanesbrands”) that are linked to this site (collectively, the “Sites”). By viewing or using any Site, you are agreeing to the terms set forth in this Privacy Policy. For other terms and conditions that apply to your use of the Sites, please review our Legal Statement.

The Importance of Privacy at Hanesbrands
Hanesbrands takes your privacy seriously. It is for this reason that we have enacted this Privacy Policy, the purpose of which is to inform you of our commitments for the protection of your personal information and the rules we intend to follow when we collect, hold, use or disclose personal information.

Hanesbrands’ Privacy Policy is designed to meet or exceed the requirements of Canadian privacy law, including the Personal Information Protection and Electronics Document Act (PIPEDA) and Québec’s Act Respecting Personal Information in the Private Sector.

Personal Information Collected
For purposes of this Privacy Policy, “personal information” means any information by which you can be personally identified, and includes your name, address, telephone number, e-mail address, account number and similar information. Most Sites do not require that you submit personal information to Hanesbrands; however, some Sites may request personal information in order to help Hanesbrands serve you more effectively. Hanesbrands generally collects personal information only when you voluntarily submit such personal information to us, for example by submitting a comment or inquiry or completing a registration form. In any case, Hanesbrands will only collect personal information that is necessary for the purpose for which it was collected.

Use and Retention of Personal Information
It is Hanesbrands’ policy to maintain all personal information as confidential. To maintain the confidentiality of your personal information, this information is kept in a secure environment by Hanesbrands, regardless of the purpose for which it is submitted, and to use such personal information only for the following purposes:

• For the specific purpose for which it was volunteered (for example to submit a comment, receive account information, purchase products, apply for employment, etc.);

• To track our visitors’ use of the Sites for internal market research; and

• To notify our visitors of updates to the Sites or promotional product opportunities.

From time to time we may use the information we collect to notify you about other services we think you will find valuable and interesting, such as updates to the Site. However, if you do not want to receive this information, you can let us know when you register by using the tick box provided or by emailing us at questions@hanes.ca. It is Hanesbrands’ policy to keep personal information only for so long as needed for such purposes. Hanesbrands does not sell, rent or otherwise distribute to third parties personal information about visitors to the Sites, except as needed for Hanesbrands to provide the services for which such information was volunteered. However, the Sites contain links to sites controlled by, and pages maintained by, independent third parties. Hanesbrands does not control use of information provided to such third parties. If you access other sites using the links provided, the operators of these sites may collect information from you which will then be used by them in accordance with their privacy policy, which may differ from ours.

You should read the individual privacy policies of such sites and make an informed decision as to whether or not you wish to use these sites based on their privacy practices. However, even though Hanesbrands has implemented methods designed to ensure the protection of your personal information that are considered to be effective, we cannot guarantee that such information will not be lost, used unlawfully or modified in a fraudulent manner since no date transmission over the Internet can be guaranteed to be completely confidential. Consequently, Hanesbrands bears no liability for the use that may be made of the information by you or a third party. Authorized third parties may need access to some of your personal information to provide the services for which you provided such information or as required by law. For example, if you purchase a product, we may use third party shippers to deliver the order to you and we would need to provide the shipper with your name and address. It is Hanesbrands’ policy to provide to third parties only that amount of personal information that they require to complete the requested service or transaction. In other cases, duly authorized government representatives may request access to personal information in the context of a police investigation or other legally justified purpose.

Given the global nature of both the Internet and Hanesbrands, using the Internet to collect and process Personal Data usually involves the transmission of data on an international basis. By browsing the Site and communicating electronically with us, you agree that we may export Personal Data to one or more of our offices in other countries and process it there in accordance with this policy. Although data may be held in countries that do not have strict data privacy laws, we do take steps to maintain the privacy and security of your Personal Data. Moreover, while personal information is held in another country, it is subject to the laws of that country and no policy or contractual provision can override those laws

Protection of Children’s Privacy
Hanesbrands does not knowingly collect personal information from children under the age of 13. If Hanesbrands becomes aware that it has inadvertently gathered personal information from a child under the age of 13, we will delete that information from our system.

Access Rights
You have a right to review personal information about you that is held by Hanesbrands. To obtain a copy of your personal information, or to request deletion of all personal information about you in Hanesbrands’ possession, e-mail us at questions@hanes.ca.

Cookies
A “cookie” is a data file sent by a web server to a web browser that enables the server to retrieve and collect information back from the browser. We use “cookies” to identify your computer when you visit the Site (our server recognizes information regarding your domain name or access provider and e-mail address) to understand how you and other visitors use the Site so that we can serve you better. Most Web browsers automatically accept cookies but you can usually change your browser to disable this function.

Policy Revisions
Hanesbrands reserves the right, at its discretion, to change, modify, add, or remove portions of this Privacy Policy at any time. You should check this page periodically for changes.
